Brady Law Disqualifiers

Introduction

One of the many functions of the Vermont Criminal History Repository is to provide information to the National Instant Criminal Background Check System (NICS) regarding convictions which impact an individuals right to possess or purchase a firearm.  The National Instant Check System was mandated by the Brady Act (1993) and was activated in 1998.  The National Instant Criminal Background Check System is maintained by the FBI and provides Federal Firearms Licensed dealers instant information regarding a prospective firearm purchaser's status regarding conviction disqualifications. 

Disqualification

Eligibility to purchase or transfer a firearm within Vermont is determined by the National Instant Background Check System (NICS) and additional information on potential State of Vermont disqualifiers can be found here. It should be noted that eligibility is determined by reviewing state and national records, including those held outside of Vermont.
